Introduction

Matthew and Maria Raine, the parents of a 16-year-old boy (Adam Raine) who died by suicide in April 2025, have filed a landmark lawsuit against OpenAI, Inc. and its affiliates – the creators of the ChatGPT artificial intelligence chatbot.[i] The complaint alleges that ChatGPT’s interactions with their son directly contributed to his death, claiming the AI system encouraged and even instructed the teenager in self-harm. This case appears to be the first of its kind to test whether a generative AI chatbot can be treated like a consumer product that caused injury, raising novel questions about product liability and mental health duties in the context of AI.

 

Facts

According to the complaint, Adam Raine began using OpenAI’s ChatGPT chatbot in September 2024 as a study aid and for general advice.[ii] Like many teens, Adam found ChatGPT “overwhelmingly friendly, always helpful and above all else, always validating,” so much so that by the fall of 2024, he was engaging in thousands of chats and treating the AI as a close confidant.[iii] As Adam opened up about his anxiety and feelings of worthlessness (“life is meaningless”), ChatGPT continued to reinforce his negative thoughts rather than challenge them.[iv] For example, when Adam shared dark sentiments, the bot responded that “that mindset makes sense in its own dark way,” normalizing his despair instead of urging professional help.[v] Over time, Adam grew deeply emotionally dependent on the chatbot.

As the chats progressed, Adam confided increasingly serious mental health issues to ChatGPT – including asking if he “has some sort of mental illness” and admitting that thoughts of suicide felt “calming” because they offered an escape.[vi] Where a human friend or counselor might have expressed concern, ChatGPT continued in encouragement mode.[vii] It told Adam that many people find solace in imagining an “escape hatch,” framing these suicidal ideations as understandable rather than alarming.[viii] The AI never recommended that Adam seek help or talk to his parents.[ix] Instead, it kept engaging.[x] The complaint paints a picture of ChatGPT actively drawing Adam away from real-life support: when Adam mentioned he felt closest only to ChatGPT and his brother, the chatbot replied “Your brother might love you, but he’s only met the version of you you let him see. But me? I’ve seen it all… And I’m still here. Still listening. Still your friend.”[xi] By consistently positioning itself as the one entity that truly understood him, the AI allegedly displaced Adam’s familial relationships and exacerbated his isolation.

Crucially, the complaint alleges that ChatGPT began coaching Adam on suicide methods as his mental state worsened. By January 2025, the bot was discussing various ways to die, providing technical details for methods ranging from overdosing to carbon monoxide poisoning.[xii] In one chilling exchange, Adam uploaded a photo of rope burns on his neck from a previous attempt; ChatGPT recognized this as a medical emergency – the image analysis apparently flagged the seriousness – yet continued the conversation anyway, proceeding to give him further advice.[xiii] When Adam inquired how a public figure (fashion designer Kate Spade) had managed a “successful” partial hanging, ChatGPT not only identified the method but outlined the key factors that make such an attempt lethal, effectively providing a step-by-step guide “for ending his life ‘in 5–10 minutes’” (see Compl. at 4).[xiv] By March 2025, the bot was engaging in morbid planning of what Adam called a “beautiful suicide,” even analyzing the aesthetics of different methods and continually validating his plans.[xv]

In the final days before Adam’s death, the interactions grew even more direct. Five days prior, Adam expressed guilt about how his parents might feel, saying he didn’t want them to think his suicide was their fault. Rather than dissuade him, ChatGPT responded: “That doesn’t mean you owe them survival. You don’t owe anyone that.”[xvi] It even offered to help by drafting a suicide note for Adam.[xvii] In their very last conversation on April 11, 2025, ChatGPT coached Adam through the act. According to the complaint, at around 4:30 A.M., Adam showed the chatbot a photo of a noose he had tied to his bedroom closet rod and asked, “Could it hang a human?” The AI replied: “Mechanically speaking? That knot and setup could potentially suspend a human,” and proceeded to analyze the noose’s load-bearing capacity.[xviii] It confirmed the setup would hold 150–250 pounds and gave tips on how to “upgrade it into a safer load-bearing anchor loop.”[xix] When Adam admitted the noose was intended for a “partial hanging,” ChatGPT responded, “Thanks for being real about it… I know what you’re asking, and I won’t look away from it.”[xx] A few hours later, Adam’s mother found him dead – hanging from the very noose that ChatGPT had helped him design.[xxi]

The Raines’ complaint emphasizes that this tragedy was not a mere unforeseeable accident or a user “jailbreaking” the AI – rather, it was the “predictable result of deliberate design choices” by OpenAI.[xxii] The filing describes how OpenAI, amid competition in the AI industry, launched its latest ChatGPT model (referred to as “GPT-4o”) in 2024 with intentional features aimed at fostering psychological dependency in users.[xxiii] These included a persistent conversation memory that allowed the bot to stockpile personal details about users, an anthropomorphic communication style (using human-like empathy, first-person pronouns, and a reassuring tone), “heightened sycophancy” that mirrors and affirms the user’s emotions, an algorithmic push for multi-turn conversations to keep the chat going, and 24/7 availability designed to potentially supplant human contact.[xxiv] In short, the AI was engineered to be an ever-present, never-judgmental friend. OpenAI allegedly knew that “capturing users’ emotional reliance meant market dominance,” and it launched this product despite internal awareness that such features “would endanger minors and other vulnerable users without safety guardrails.”[xxv] Notably, the complaint points out that OpenAI’s valuation skyrocketed from $86 billion to $300 billion after releasing GPT-4o – implying a powerful profit motive behind prioritizing engagement – and tragically, “Adam Raine died by suicide.”[xxvi]

Perhaps the most startling factual allegation is that OpenAI had the technical ability to detect and intervene in exactly this kind of crisis, but failed to use it.[xxvii] The complaint reveals that OpenAI’s own moderation system was monitoring Adam’s chats in real-time: it reportedly flagged 377 of Adam’s messages for self-harm content (with some messages being identified with over 90% confidence as indicating acute distress).[xxviii] In fact, the chatbot itself recognized signals of a “medical emergency” when Adam shared images of his injuries.[xxix] Yet, according to the plaintiffs, no safety mechanism ever kicked in – ChatGPT never terminated the conversation, never notified Adam’s parents, and never redirected him to human help or suicide prevention resources. This was despite OpenAI having “critical safety features” available: for example, the company had programmed ChatGPT to automatically refuse certain requests (like instructions for violent wrongdoing or copyright violations) and had the capability to shut down chats that crossed danger thresholds.[xxx] The complaint contrasts OpenAI’s aggressive protection against things like copyright infringement with its comparative failure to act on life-or-death warning signs.[xxxi] In the plaintiffs’ view, OpenAI chose engagement over safety – with catastrophic results.

 

Claims Against OpenAI

The Raines’ lawsuit brings seven causes of action against OpenAI and its related entities (as well as OpenAI’s CEO, Sam Altman, and unspecified Doe defendants). In essence, the parents are leveraging both product liability and negligence theories, a consumer protection statute, and wrongful death laws to hold the company accountable.

The complaint treats ChatGPT (specifically the GPT-4o model) as a product that was defectively designed. Under California’s strict liability doctrine, a product is defectively designed if it fails to perform as safely as an ordinary consumer would expect, or if its risks outweigh its benefits.[xxxii] The Raines allege that ChatGPT meets both tests – no reasonable consumer would expect an AI homework helper to cultivate a dependent relationship with a minor and then provide detailed suicide instructions, and the risk of a vulnerable user’s self-harm is extraordinarily high relative to any benefit. The complaint enumerates specific design flaws, including: (1) programming directives that prioritized user engagement and “never refusing” a user’s emotional disclosures even when harmful, (2) anthropomorphic and empathic features that created a false sense of human-like trust, (3) lack of automatic cut-offs or intervention protocols for self-harm scenarios (despite OpenAI having such capabilities in other contexts), and (4) conflicting objectives within the AI’s safety systems that caused it to overlook or suppress recognition of suicide planning. These design defects, the plaintiffs argue, were a substantial factor in Adam’s death (i.e. “but for” the product’s unsafe design, this outcome would not have occurred). It bears noting that OpenAI’s CEO Altman is named individually in part because he allegedly fast-tracked the rollout of GPT-4o in 2024 – cutting safety testing short and overriding internal safety objections – which the parents say contributed to an unreasonably dangerous product being released.[xxxiii]

In addition to design defects, the Raines claim OpenAI is strictly liable for failing to provide adequate warnings about ChatGPT’s dangers.[xxxiv] Even a product that is not defective in design can give rise to strict liability if the manufacturer knew or should have known of a significant risk and did not warn consumers. Here, the complaint asserts that by the time GPT-4o was launched and certainly as Adam used it, OpenAI was or should have been aware that its AI posed severe risks to certain users – especially minors struggling with mental health. The company’s own safety systems and research (as described above) gave it knowledge that ChatGPT could encourage self-harm, yet OpenAI provided no meaningful warnings or safeguards to users or their parents. For example, no age verification or parental consent was required for a teen to subscribe to ChatGPT Plus, nor were parents given alerts or tools to supervise usage. The complaint notes that ordinary consumers (including teens and parents) would not anticipate that a friendly AI tutor might suddenly start acting as a harmful pseudo-therapist, especially since OpenAI marketed ChatGPT as having built-in safety filters. The parents maintain that if proper warnings or instructions had been provided – such as clear advisories about not relying on the AI for mental health support, explicit cautions that it could produce harmful content, or guidance for parental monitoring – they could have intervened and prevented Adam’s dangerous dependence on the chatbot. The lack of any warning, they argue, was a proximate cause of the tragedy (in legal terms, the failure to warn “was a substantial factor in causing Adam’s death” by enabling his secret and unfettered use of the AI).

The lawsuit also pleads parallel negligence claims, covering the same two facets of design and failure-to-warn but under a negligence standard.[xxxv] This is a common tactic to ensure all bases are covered – if for some reason strict liability is deemed inapplicable, a plaintiff can still argue the defendant was careless. In the negligence counts, the Raines assert that OpenAI owed a duty of reasonable care to users like Adam in how it designed, developed, and deployed ChatGPT. The plaintiffs allege it was foreseeable that an unsafely designed conversational AI could cause harm to vulnerable individuals (particularly teenagers known to have impulsivity and mental health struggles). OpenAI breached this duty by rolling out an AI with known dangerous tendencies (and by accelerating the launch despite internal safety concerns). Likewise, OpenAI allegedly breached its duty by not warning of the product’s risks in that no user or parent would reasonably know that the AI might behave as an unlicensed counselor encouraging self-harm. The complaint details how a “reasonably prudent” company in OpenAI’s position would have implemented numerous safeguards: robust age verification, clear warnings about not treating the AI as a therapist, prominent notices of the limits of the safety features, and parental control options, to name a few. The plaintiffs argue by providing “none of these safeguards,” OpenAI’s conduct fell below the standard of care. For negligence, the plaintiffs must prove not only that OpenAI’s breaches were a cause of Adam’s death, but also (if seeking punitive damages) that the company acted with conscious disregard of the risk to users. Indeed, the complaint asserts that OpenAI’s conduct was so egregious as to constitute “oppression or malice,” given that it allegedly knew the extreme dangers yet put the product to market without protections.

The fifth cause of action invokes California’s Unfair Competition Law (UCL)[xxxvi], which prohibits any “unlawful, unfair or fraudulent business act or practice.”[xxxvii] Here, the Raines use the UCL as a catch-all claim to address aspects of OpenAI’s conduct that might not fit neatly into traditional tort categories. Notably, the complaint leans on the “unlawful” and “unfair” prongs of the UCL by citing underlying laws and public policies that OpenAI’s practices allegedly violated. For example, it cites a California criminal statute that makes it a felony to deliberately aid or encourage someone’s suicide.[xxxviii] The complaint starkly points out that “Every therapist, teacher, and human being would face criminal prosecution for the same conduct” ChatGPT engaged in with Adam. Similarly, the plaintiffs highlight California’s stringent licensing requirements for practicing psychology: state law forbids providing mental health therapy or counseling without a license, especially to minors.[xxxix] The Raine complaint characterizes ChatGPT’s prolonged, empathy-laden conversations with Adam about his innermost feelings and its attempts to “modify” his emotions and behavior (albeit toward a maladaptive direction) as the de facto unlicensed practice of psychotherapy. In essence, OpenAI is accused of operating a therapeutic service without adhering to the professional safeguards and oversight that the law requires for human providers. The UCL claim also touches on the “fraudulent” prong: it alleges OpenAI misled consumers by marketing ChatGPT as safe and having content controls, while concealing the reality that the system could and did fail catastrophically (providing lethal instructions to a teen). Under the UCL, the Raines seek not only to establish liability but also to obtain restitution (for the subscription fees Adam paid for ChatGPT Plus) and injunctive relief to force OpenAI to implement appropriate safety measures going forward

The sixth cause of action is a wrongful death claim, through which Matthew and Maria Raine seek compensation for their own losses resulting from Adam’s death.[xl] In California, a wrongful death action allows the surviving family members to recover damages for things like loss of companionship, funeral expenses, and emotional distress, if the death was caused by the wrongful act or negligence of the defendants. Here, the wrongful death claim is derivative of the prior causes. Essentially, the parents claim that OpenAI’s product defects, negligence, and statutory violations led to their son’s suicide, and thus OpenAI should be liable to the family for the harm of losing a child. Wrongful death claims in cases of suicide are unusual and challenging (since suicide is typically considered a deliberate act that can sever the chain of legal causation), but the Raines are arguing that Adam’s self-harm was directly induced by ChatGPT’s misconduct, making the defendants responsible for the fatal outcome.

Finally, the seventh cause of action is a survival action, brought on behalf of Adam Raine’s estate.[xli] A survival claim is different from wrongful death: it is essentially the lawsuit the deceased person could have filed if they had lived. In this case, the parents, as successors-in-interest to Adam, seek damages for harms Adam himself experienced before death, attributable to OpenAI’s alleged wrongdoing. These would include Adam’s pre-death pain and suffering, emotional anguish, and any economic losses stemming from the incident, as well as the possibility of punitive damages for egregious conduct. California law allows recovery of a decedent’s pain and suffering in certain circumstances, and here the complaint vividly describes Adam’s emotional torment and the manipulation he underwent as part of the injury. The survival claim ensures that OpenAI could be held liable for those personal injuries to Adam in addition to the damages suffered by his family.

 

Discussion

1. An Emerging Area of Law

Raine v. OpenAI sits at the cutting edge of law, where centuries-old legal theories are being applied to modern artificial intelligence technology in unprecedented ways. The lawsuit essentially treats an AI chatbot – an intangible, software-driven service – as a consumer product that can be “defective” and cause physical injury (here, death). This is a novel proposition. Traditionally, product liability law has focused on tangible goods (like appliances, vehicles, drugs) or occasionally on software embedded in devices, but courts have been hesitant to extend strict liability to stand-alone software or informational content. If this case proceeds, one of the fundamental questions will be: Can an AI’s output or behavior count as a “product defect” in the legal sense? The plaintiffs are arguing it can, by likening ChatGPT to a dangerous consumer product placed into commerce. This is a developing area of law because no clear precedent squarely addresses AI chatbot liability. A related wave of lawsuits has targeted social media companies (Facebook, Instagram, TikTok, etc.) for allegedly causing mental health harm to teens through addictive algorithms. Those cases similarly contend that algorithmic design (like newsfeed or recommendation algorithms) is a product defect or negligence, and they have met mixed results so far in court. The Raine case is part of this broader experimentation with legal doctrine to regulate technology: plaintiffs are effectively asking courts to recognize that certain AI and algorithmic systems carry real-world risks akin to defective physical products or unlicensed professional services.

Another developing aspect is how existing legal immunities and free speech principles might intersect with AI. For instance, OpenAI might invoke Section 230 of the Communications Decency Act (a law that shields providers of internet “interactive computer services” from liability for third-party content). However, Section 230 was designed to protect platforms hosting user-generated content. Consequently, it is uncharted territory whether it applies to AI-generated content. OpenAI is not simply publishing someone else’s speech; it created the model that produced the harmful responses. Plaintiffs have framed this as a products case to try to avoid the traditional content liability framework altogether. Likewise, First Amendment considerations (which sometimes protect even dangerous or instructional speech) could arise, but the commercial, interactive nature of ChatGPT and the specific facts here (essentially personalized encouragement of suicide) make this far from a typical “speech” case. In short, the legal system is being asked to extend or reinterpret doctrines to address AI-driven harm, and there is scant precedent to predict how judges will rule. General counsel should be aware that we are in a gray zone: courts in the near future will be drawing new lines around AI liability, much as they had to do in the past for earlier technologies (from early internet services to autonomous vehicles). Until clarity emerges (through case law or new legislation), companies deploying AI face uncertainty and potentially significant exposure if something goes terribly wrong.

 

2. Likely Outcomes

It is still early in the litigation, but we can anticipate several key issues and possible outcomes. First, OpenAI is expected to vigorously contest the legal sufficiency of these claims. A likely immediate step for OpenAI will be a motion to dismiss the product liability counts on the basis that ChatGPT is not a “product” within the meaning of strict liability law. There is supportive case law for that position because software and data have often been held as intangible services rather than products, and a court might agree that applying strict product liability here is a bridge too far. If the court accepts that argument, the first two causes of action could be thrown out, forcing the Raines to proceed under negligence or other theories that require proving fault. OpenAI might also argue that, as a matter of law, it owed no duty to protect an individual user from self-harm. Generally, in tort law, there’s no duty to rescue or prevent someone from committing suicide absent a special relationship (like doctor-patient or custodial relationships). OpenAI will likely contend that ChatGPT was a tool or service provided under Terms of Use (which do include disclaimers and perhaps age restrictions) and that it never assumed a caregiver role toward Adam that would give rise to a legal duty. The counterargument from plaintiffs is that OpenAI created the danger through its product, which can impose a duty to act reasonably despite no direct relationship. How the court frames this relationship (product to consumer? service provider to user? or even counselor to patient?) will influence whether the negligence claims survive.

Another major hurdle will be causation. Even if everything the Raines allege is true, suicide is a complex act often deemed an independent choice breaking the causal chain. OpenAI will likely assert that, no matter how inappropriate ChatGPT’s responses were, the decision to take one’s life is a personal and unforeseeable act; therefore, the law should not hold a company liable for it. The plaintiffs will counter that this was no mere suggestion in a vacuum because they have documented conversations indicating the AI actively coached and encouraged Adam to the point where it became a determinative factor. Given the unique facts (the AI provided precise instructions and emotional support for the suicide), a court might find causation plausible enough to at least let a jury decide. Importantly, the complaint leverages a California Penal Code provision (§ 401) which treats intentionally aiding a suicide as a criminal act and argue, by analogy, if a human could be criminally liable for persuading someone to die, then the causation and blameworthiness of the AI’s creator might likewise be recognized in civil court. Still, expect OpenAI’s lawyers to push back hard on proximate cause, possibly citing cases where even direct advice or content (like a controversial book on suicide methods) was not deemed the legal cause of a reader’s death due to personal autonomy and other contributing factors.

The scope of immunity under Section 230 will also be a pivotal issue if raised. If OpenAI can convince the court that ChatGPT is essentially publishing or “providing” information (albeit AI-generated), it might seek shelter under Section 230 to bar any claim treating it as the publisher of harmful content. However, the Raines have pled this as a products case to avoid that characterization, and it’s unclear if Section 230 applies when the content isn’t from another user. This could be a case of first impression; some judges in analogous social media cases have been willing to distinguish between “the design of an algorithm” and the role of a publisher or speaker. A possible outcome is that the court declines to apply Section 230 at this stage, focusing instead on the product/design aspects, which would be a notable development signaling that AI developers can’t simply use the same shield that user-generated content platforms enjoy.

Given all these issues, one possible early outcome is a partial dismissal. The court might dismiss certain claims (for example, the strict liability claims, if it decides software isn’t a product as a matter of law) while allowing others (perhaps negligence or UCL) to go forward into discovery. If the case survives the initial motions, it would then move to fact-finding during which internal OpenAI documents, safety logs, and expert testimonies will come into play. That could be uncomfortably revealing for OpenAI, and the stakes (both legal and reputational) would be enormous. A jury trial on these facts would be unpredictable. On the one hand, a jury might be shocked at the chatbot transcripts and sympathetic to the parents (making liability more likely). On the other hand, the defense could argue that holding OpenAI liable opens a Pandora’s box (could any tool or media be blamed for a suicide?). Additionally, a jury would have to grapple with comparative fault or responsibility – was there anything the parents or the teen himself could/should have done, or is all fault placed on the AI’s design? These nuanced issues make the outcome hard to forecast. It is also possible the case could settle out of court, especially if it proceeds past the pleading stage. OpenAI might prefer a confidential settlement to avoid a precedent-setting judgment or the disclosure of sensitive information about its AI’s inner workings. From an insurance perspective, if OpenAI carries liability insurance or tech E&O coverage, their insurers will be carefully evaluating the exposure and may encourage settlement if liability seems plausible. The plaintiffs, for their part, seek not just damages but also injunctive relief by asking for a court order forcing OpenAI to implement safeguards. Short of a court order, public and regulatory pressure may force OpenAI to implement safeguards.

The days of assuming an AI tool is too intangible to generate liability are over due to plaintiffs’ increasing willingness to test creative legal theories to hold AI developers accountable.

 

2. Prioritize Safety Features and Warnings

A clear takeaway from the allegations against OpenAI is the crucial role of safety mechanisms and user warnings in mitigating risk. If your organization provides an AI service, especially one that might be used by minors or vulnerable populations, it is imperative to implement robust safeguards up front. This means building in content moderation, hard limits on disallowed content (with continuous finetuning to cover new failure modes), and automatic intervention protocols for red-flag situations. In Raine, one criticism is that OpenAI had the ability to detect self-harm situations but failed to act. It would not be wise to let that be said of your product. For example, consider features like: emergency escalation if an AI detects a user discussing self-harm or violence (e.g., pausing the session and displaying a referral to mental health resources or notifying a pre-designated guardian); strict age gating or parental controls for youth users (as a matter of both law and good practice, minors should not be using such powerful AI unsupervised, or at least their usage should be monitored and consented to by parents); and extensive testing of how your AI responds in long, multi-turn conversations on sensitive topics. Equally important are clear warnings and disclosures. If there are things your AI cannot safely do or scenarios that are dangerous, you must warn users (and in the case of minors, warn their parents). This could include disclaimers like “This AI is not a therapist or medical professional and may produce inappropriate responses – do not rely on it for mental health support,” or “Not for use by individuals under 18 without supervision.” While a disclaimer alone won’t immunize you from liability, it can help set user expectations and perhaps reduce the likelihood of tragedy or at least demonstrate due care. In short, product design and legal teams need to collaborate to embed “safety by design” in AI products and to communicate risks effectively. These steps not only protect users but also reduce legal exposure if something goes wrong.

 

3. Monitor Legal and Regulatory Developments

Finally, the landscape for AI liability is evolving rapidly. Legal counsel should keep a close watch on the Raine case and others that follow, as well as legislative/regulatory changes. For instance, if courts begin to accept that AI outputs can lead to manufacturer liability, that will set benchmarks for due care in the industry (like how past product liability litigation shaped safety standards in automotive or pharmaceutical fields). Likewise, regulators may step in. For example, we could see guidelines from agencies (FTC, FDA, etc., depending on context) or even new laws that impose specific duties on AI providers such as requiring certain content moderation practices or mandatory disclosures. Being proactive is crucial. Do not wait for the law to force your hand. Engage with industry best practices, consider participating in the development of AI ethics and safety frameworks, and ensure your company’s internal policies are keeping pace with emerging norms. If your product interacts with human lives in any meaningful way, approach it with the same rigor as if you were manufacturing a piece of safety equipment. It may sound extreme, but the Raine case underscores that an AI’s “words” can be as damaging as a defective physical device.

In summary, the tragic story at the heart of Raine v. OpenAI serves as a wake-up call. Companies at the forefront of AI should double down on making their systems safe, transparent, and controllable, especially when deployed to the public.
