Joshua Ferguson

Joshua Ferguson is Senior Counsel at Tyson & Mendes’ New York office. He defends clients in a broad variety of tort litigation, including premises liability, construction defect, and fraud cases. He also provides coverage analysis for insurers, as well as litigating coverage disputes.

Mr. Ferguson is an experienced litigator who has represented clients throughout New York’s state and federal courts. Through motion practice, he has obtained summary judgment for trucking/transportation clients, and dismissals of federal statutory claims. Mr. Ferguson has also been successful in mediating matters and negotiating advantageous settlements on behalf of his clients. He has been responsible for affirmative litigation seeking to recoup fraudulently obtained insurance proceeds. Mr. Ferguson has been named a “Rising Star” by Super Lawyers since 2018.

Mr. Ferguson obtained his J.D. from the Benjamin N. Cardozo School of Law, where he served as Senior Articles Editor for the Cardozo Law Review. He obtained his undergraduate degree from Vassar College, where he graduated with degrees in Asian Studies and Japanese Language and Literature. Mr. Ferguson’s exceptional writing skills have frequently been recognized, winning him both the Sophia Zen-Chen Award for his undergraduate thesis, as well as the Benjamin N. Cardozo Writing Award for an appellate brief. Mr. Ferguson has been recognized from Best Lawyers: Ones to Watch® since 2023 for insurance law.

Mr. Ferguson is a long-time member of the Brooklyn Botanic Garden, where he studies horticulture as part of their continuing education program. He also enjoys discussions with his book club, eclectic foods and cocktails, and trying to keep his mischievous cat entertained.
