Daniel Erwin

Daniel Erwin is a Partner in Tyson & Mendes’ Houston office. His practice focuses on complex, high-exposure cases, frequently involving catastrophic personal injury in transportation and trucking matters, as well as general civil litigation, often for Fortune 500 companies.

Though based in Houston, Mr. Erwin has spent his career regularly handling matters across all of Texas. In his 15+ years of experience in litigation, he has focused his practice on transportation matters, complex litigation, commercial litigation, products liability, premises liability and construction defect. Mr. Erwin primarily defends catastrophic-loss/high-exposure casualty matters. His experience includes litigating trials in Texas and Arkansas. His most recent was a two-week trial in Harris County, Texas that resulted in a favorable verdict, seeing plaintiffs in a bus-accident case recover a jury verdict of just three percent of the amount plaintiffs requested from the jury. His trial experience also includes serving as “parachute” defense counsel, assuming defense of cases weeks before trial, resulting in multiple favorable settlements during trial or on the eve of trial. He also helped secure a complete summary judgment (ultimately upheld through appeals) for a client in a wrongful death matter hinging on the employee coming-and-going rule in a course-and-scope dispute.

Mr. Erwin is admitted to practice law in Texas state courts, federal courts in Texas, and before the Fifth District Court of Appeals. He is a member of the State Bar of Texas Business Law and Litigation Sections; Texas Association of Defense Counsel; Defense Research Institute’s (DRI) Trucking Law Committee; and the Trucking Industry Defense Association (TIDA).

Mr. Erwin obtained his J.D. with honors from South Texas College Law, where he was an Associate Editor for the Corporate Counsel Review.  He earned his B.B.A. with honors from the University of Texas at Tyler, with an emphasis in business management.

In his free time, Mr. Erwin enjoys spending time with his family, traveling, practicing the art of Texas BBQ, coaching and attending his kids’ sporting events, and watching the Texas Longhorns and Dallas Cowboys.
