San Diego, CA, June 3, 2026 — National insurance defense trial firm Tyson & Mendes, LLP announced today a series of successful appellate and dispositive motions wins, including multiple motions for summary judgment and a substantial reduction in settlement exposure, reinforcing the firm’s strategic approach to early case resolution and risk mitigation.
In one case, the plaintiff asserted claims against the firm’s client, a private security company, for intentional torts, statutory violations, and negligent hiring, training, and supervision. Sara Woods, Partner in the firm’s Fresno office, led the defense and successfully obtained summary judgment on all claims. The court also granted the defense’s motion to recover attorney fees, fully resolving the case in the client’s favor.
“This outcome reflects a disciplined, strategic approach to litigation by using early motions practice to test claims, shift leverage, and drive more reasonable resolutions,” said Ms. Woods.
In another case handled by the firm’s Jacksonville office, a plaintiff who fell due to deteriorated pavers on an outdoor patio asserted claims against the firm’s client, a condominium association. She alleged she sustained significant brain injuries, demanding close to $3 million. Partner Haldon Greenburg, Senior Counsel Samantha Epstein, and Associate Abigail Gallagher pursued early resolution, filing a motion for summary judgment based on the open and obvious doctrine. The plaintiff had previously admitted to being distracted by walking a dog and was not looking at the pavers when she fell. The court granted the defense’s motion for summary judgment in the case, which posed significant risk to the client if the motion was unsuccessful.
“By delivering on The Apex’s key themes of reasonableness, common sense, and responsibility, we were able to demonstrate why this case did not have legal merit, preventing a case with strong, plaintiff-friendly injury reports from going to trial,” said Mr. Greenburg. The Apex is the firm’s data-driven and trial-tested blueprint for the defense to use throughout the life of a claim to prevent disproportionate outcomes.
The results are consistent with Tyson & Mendes’ data-driven strategies and approach to controlling litigation exposure and preventing Nuclear Verdicts® through proactive and strategic resolution, motions practice, and trial advocacy.
