Mark Didak
Mark Didak is Senior Counsel in Tyson & Mendes’ Los Angeles office.
Mr. Didak brings more than four decades of experience handling all types of civil litigation and claims, from automobile accidents and premises liability to property disputes, legal and medical malpractice, malicious prosecution, and complex coverage and bad faith cases. He has defended hundreds of auto, general liability and professional negligence claims for the policyholders of many of the nation’s largest insurers. He has represented insurers in coverage and bad faith matters in claims with a combined exposure of over one billion dollars, including The Hartford Companies, AIG Risk Management, National Union, Fidelity & Deposit Company of Maryland, Argonaut Insurance, Escrow Agents’ Fidelity Corporation, 21st Century, Interinsurance Exchange of the Automobile Club, and USAA, among others. These included very high exposure claims of $800 million, $400 million and $220 million. His experience also includes litigation under the Unfair Competition Law, Consumer Legal Remedies Act, Pregnancy Discrimination Act, Americans With Disabilities Act, Private Attorney Generals Act, and False Claims Act. Mr. Didak drafted and successfully lobbied passage of Senate Bill 2450, substantially rewriting California Financial Code provisions governing fidelity coverage for Escrow Agents’ Fidelity Corporation, of which he was General Counsel. In 2005, Mr. Didak was lead counsel for a successful plaintiff class of over 3.3 million California public education employees—among the largest in state history—in Malek v. Blue Cross of California, (2004) 121 Cal.App.4th 44, a case involving enforceability of health insurance arbitration agreements; he now leverages this experience to inform his defense litigation. His amicus brief in Yvanova v. New Century Mortgage Corp., (2016) 62 Cal.4th 919, was influential in shaping the California Supreme Court’s unanimous ruling that helped homeowners achieve a landmark victory on standing to attack void transfers of their mortgage notes and deeds of trust. Mr. Didak has won over eighty percent of the more than 250 motions for summary judgment, summary adjudication, and judgment on the pleadings he has brought during his career, winning cases outright or rulings that forced cases to settle on terms favorable to his clients.
Mr. Didak obtained his J.D. at the University of Southern California. He obtained his B.A. in anthropology at Reed College.
Mr. Didak is a Los Angeles native. He and his wife enjoy movies, travel, sports, visits with their children and grandson, and participation in community organizations.
