Kimberly Parson

Kimberly Parson is a Partner in Tyson & Mendes’ New Jersey office, where she leads a team of multiple attorneys.

Ms. Parson’s practice encompasses a broad range of defense and litigation matters, including commercial litigation and insurance coverage litigation. She represents clients in cases involving products liability, premises liability, personal injury, construction defects, medical malpractice, legal malpractice, professional liability, and employment practices liability. She also defends educational institutions such as universities, colleges, private schools, and boarding schools against a variety of claims, both before and after lawsuits are filed.

In the area of insurance coverage, Ms. Parson represents and advises insurance carriers regarding their coverage obligations and the prioritization of coverage under various insurance policies, including primary, umbrella, and excess policies. Her expertise covers numerous types of insurance such as commercial general liability (CGL), professional liability, errors and omissions, directors and officers (D&O), property and casualty, commercial auto for both intrastate and interstate motor carriers, construction insurance, Wrap insurance (OCIP/CCIP), employer’s liability coverage, business interruption, and workers’ compensation.

Ms. Parson has achieved significant victories in defense litigation. She secured summary judgment for her laboratory client in a complex multi-million-dollar IVF preimplantation genetics testing case, by demonstrating that the client’s testing protocols were state-of-the-art and that the report was both accurate and clear, and establishing that the Plaintiffs’ experts failed to render liability or causation findings regarding her client.

Additionally, Ms. Parson won summary judgment for a medical professional by establishing that the plaintiff’s expert report failed to show any deviation from accepted standards of care and lacked proximate causation. Furthermore, she demonstrated that the plaintiff’s expert was not qualified to render opinions on the standard of care regarding her client and that the expert report constituted an inadmissible net opinion.

Ms. Parson has been instrumental in securing favorable rulings for her clients in insurance coverage matters. She obtained a ruling that the property manager for the owner of a building where the underlying plaintiff was injured was not an additional insured under the owner’s CGL policy and thus was not entitled to coverage under her client’s policy.

She also secured a ruling requiring the primary insurer to provide the co-insurer with its demand for one-third of the defense costs and settlement paid in the underlying action, while dismissing another carrier’s contribution claim.

Ms. Parson served as counsel in a seminal case that is widely referenced throughout the insurance industry. The case involved federal court interpretation of New Jersey law and established that an excess insurer was entitled to reimbursement for the defense of its mutual insured when the primary insurer wrongfully denied coverage and failed to provide a defense in the underlying action.

Ms. Parson is admitted to practice law in New Jersey, New York, and Pennsylvania, as well as before the United States District Court for the District of New Jersey and the Third Circuit Court of Appeals. She is also the Past Chair for the New Jersey State Bar Association Insurance Law Section (NJSBA), a Fellow of the NJSBA Leadership Academy, a member of NJSBA’s Insurance Defense Committee, and appointed to the New York State Bar Association Committee on Association Insurance Program. Her achievements include a Certificate of Special Recognition from the U.S. Senate for outstanding leadership in legal services and a Resolution of Honor from the New Jersey Assembly for exemplary professional legal acumen.

Ms. Parson enjoys spending her free time immersed in literature, watching foreign films, and taking long walks. These activities reflect her appreciation for diverse cultures, her love of storytelling, and her commitment to maintaining a balanced lifestyle.
