Taters Farm (“Taters”) is a potato farm that hired No-Eyez Herbicide Application Services (“No-Eyez”) to apply an anti-sprouting chemical to Tater’s potatoes located in a storage barn. The chemical is used to prevent the potatoes from sprouting eyes, which would make them less marketable. No-Eyez used a chemical called “Sprouts-B-Gone”, a non-toxic substance approved for human consumption. Taters Farm is located in Idaho on the border with Washington State. On the Washington side of the border, Jeff Spicoli purchased an old potato farm and converted it into a licensed marijuana growing and processing facility called Far Out Farms. The Washington State Cannabis Board (WASCB) closely monitors Far Out Farms, including routine inspections and testing of Far Out Farms’ products.  During Far Out Farms’ first crop harvest, the WASCB detected Sprouts-B-Gone in the harvested marijuana and ordered the entire crop to be destroyed. Spicoli suspected the Sprouts-B-Gone came from Tater’s Farm. Spicoli sued Tater’s Farm for damage to their marijuana crop. Taters tendered the defense to No-Eyez’s, who referred the suit to their insurer, Unique Risk Insurance. You are the adjuster for Unique Risk Insurance.
