Daytona Beach, FL – October 31, 2025 — National insurance defense firm Tyson & Mendes, LLP announced today another defense victory in a personal injury trial arising from a rear-end collision, where the plaintiff sought $2.267 million in damages. The jury returned a full defense verdict of $0 in a case that involved significant alleged injuries, and in a jurisdiction known for delivering outsized and unjust Nuclear Verdicts®.
The case involved an admitted-liability rear-end, motor vehicle accident in which the plaintiff sought emergency treatment immediately following the collision and later underwent surgery.
The defense team was led by Jason Boone, Partner in Tyson & Mendes’ Jacksonville, Florida and Atlanta, Georgia offices and Ashley L. Hollingsworth, Partner in the firm’s Jacksonville, Florida office. Boone and Hollingsworth delivered persuasive arguments that clearly resonated with jurors, who were empowered to deliberate using common sense and reasonableness instead of unchecked emotion.
Referencing the foundational principles of The Apex – the firm’s data-driven and trial-tested blueprint for the defense to prevent Nuclear Verdicts®, lead trial counsel Jason Boone said, “We leaned on The Core Four by personalizing our client, giving a number while adhering to court orders limiting the extent of anchoring permitted, accepting responsibility, and arguing pain and suffering.” The Apex is detailed extensively in the firm’s newest book, Nuclear Verdicts®: The Apex – Break the Pattern, authored by Robert F. Tyson, Jr., Founding Parter of Tyson & Mendes, and Cayce E. Lynch, the firm’s National Managing Parter.
In this case, the defense accepted full responsibility from the outset and personalized the defendant as a father and husband returning home from a family vacation with his young children at the time of the accident. “Jurors saw the truth; they saw a human being who made a mistake, and they were easily able to reach a fair number,” said Hollingsworth. The defense also countered the plaintiff’s pain and suffering arguments with persuasive, evidence-based arguments articulating both the impact of the accident on plaintiff’s life, and the impact of money on plaintiff’s life. Boone added, “We were able to deliver the good news that this plaintiff has a full life and is able to enjoy travel and scuba diving. We cared to get to know this plaintiff, and the jury saw that.”
“This case proves that when you tell the truth, embrace responsibility, and focus the jury on what the evidence truly supports, they will do the right thing,” Mr. Boone added. “We’re proud to have achieved fairness and justice for our clients in this case and are grateful to the jury for their service.”
