Robert Fitzgerald
Robert Fitzgerald is an Associate in Tyson & Mendes’ Philadelphia Office. He concentrates his practice on representing insurance carriers and their insureds in civil litigation matters.
Prior to joining Tyson & Mendes, Mr. Fitzgerald was an Associate at Rebar Kelly, where he gained experience handling a wide range of liability defense cases and became skilled at developing strong defense strategies from the outset of litigation. He began his career at Gabell Beaver, LLC, where he assisted in contract drafting for commercial real estate clients. Mr. Fitzgerald has a proven record of delivering favorable outcomes for his clients through strategic motion practice and effective negotiation. He drafted a Motion for Summary Judgment that resulted in the complete dismissal of the Insured from a contentious fertility treatment negligence case, based on the Plaintiff’s inability to produce any sufficient evidence of liability. Mr. Fitzgerald also played a key role in negotiating a settlement that was more than $1 million below the plaintiff’s demand in a high-exposure case involving the alleged improper administration of prescription medication by a hospital. Additionally, he helped secure a significantly reduced liability allocation for the Insured in a serious injury case involving a moving company employee —limiting exposure to just 15% compared to 85% for the co-defendant— by demonstrating the lack of direct oversight or control. Mr. Fitzgerald is admitted to practice in Pennsylvania.
Mr. Fitzgerald obtained his J.D. from Drexel University’s Kline School of Law, where he graduated with a certificate in business law. While in law school, he volunteered with CASA, advocating for children in the foster care system. He obtained his undergraduate degree from the University of Maryland, where he competed on the Division I wrestling team.
In his free time, Mr. Fitzgerald stays active through wrestling and music. He is an assistant coach for Arcadia University’s wrestling program, where he mentors young athletes towards achieving both their athletic and academic goals. He also enjoys songwriting on the guitar and playing for friends and family.
