Katherine Monk
Katherine Monk is an Associate in Tyson & Mendes’ Orange County office. Her practice focuses on medical malpractice, premises liability, and intellectual property.
Ms. Monk has extensive litigation experience, including representing physicians and/or health-related entities in state courts throughout California. She has been successful in positioning cases for summary judgment, including a recent case where summary judgment was granted and another where plaintiff dismissed following service of the MSJ. She is adept at providing extensive evaluations of cases. Ms. Monk has successfully obtained summary judgment for a physician accused of overmedicating a retirement home resident with psychotropic drugs. After a detailed review of the medical records, it was demonstrated that the medication listed on the prescription was not actually administered, defeating plaintiff’s claim. Ms. Monk also secured a defense in a case alleging a radiologist failed to identify a developing neck hematoma on a post-procedure x-ray wherein a permacath was placed. Working closely with an expert, she established that the patient’s fatal aortic dissection was unrelated to the alleged missed diagnosis and was instead caused by chronic, uncontrolled hypertension which spiked during a catheter reinsertion procedure. Ms. Monk successfully obtained summary judgment in a plastic surgery malpractice action by demonstrating the plaintiff’s post-operative infection occurred absent any deviation from the standard of care, as infections can develop even in the absence of negligence.
Ms. Monk obtained her J.D. from College of Law, Santa Barbara in 2023. She obtained her M.A. and B.A. from California State University, Long Beach.
In her free time, Ms. Monk enjoys photography, traveling, music, and spending time her children. She also enjoys snowboarding, movies, pop culture, and dabbling in the propagating and arranging of succulents.
