David J. Guzik
David J. Guzik is an Associate in Tyson & Mendes’ New Jersey office. His practice concentrates on personal injury and premises liability defense, employment discrimination and retaliation claims, and civil rights litigation, with additional experience defending product liability and toxic tort actions, consumer fraud and construction defect matters.
Mr. Guzik has established a strong track record of achieving favorable outcomes for clients through strategic motion practice and dispositive advocacy. He has obtained dismissal with prejudice in a defamation action that was later affirmed on appeal. Mr. Guzik has obtained dismissal at the pleading stage in multiple employment actions against municipal entities. He has also secured summary judgment in numerous premises liability cases by successfully applying the “storm-in-progress doctrine” and defenses under the New Jersey Tort Claims Act. Mr. Guzik has likewise prevailed on qualified immunity defenses for public employees at the summary judgment stage. He is admitted to practice law in the State of New Jersey and the United States District Court for the District of New Jersey. Mr. Guzik is a member of the Bergen County Bar Association and the Justice Morris Pashman American Inn of Court.
Mr. Guzik obtained his J.D. from Seton Hall University School of Law in 2017. During law school, he served as a research assistant to Professor Paula Franzese and co-authored a scholarly article published in the Rutgers University Law Review titled “The Implied Warranty of Habitability Lives: Making Real the Promise of Landlord/Tenant Reform”, 69 Rutgers L. Rev. 1 (2016).
Outside of his legal practice, Mr. Guzik maintains an active lifestyle and has completed both the United Airlines NYC Half Marathon and the Staten Island Half Marathon. He is fluent in Polish and enjoys traveling, weightlifting, and supporting the New Jersey Devils.
