David Gittelman

David Gittelman is Senior Counsel in Tyson & Mendes’ San Diego office. His practice includes vehicle accidents, slip/trip and falls, construction site accidents, construction defect, mudslides, boundary disputes, nuisance, trespass, libel/slander, assault/battery, products liability, insurance coverage, subrogation, business disputes, breach of contract, landlord/tenant disputes, and wrongful death cases.
Mr. Gittelman has been lead counsel on hundreds of civil litigation matters over the course of his career, representing homeowners and businesses from the inception of a lawsuit through trial. He is known for aggressively defending his clients through all phases of litigation. Mr. Gittelman represented homeowners accused of damaging their neighbors’ bluff due to overwatering and causing $3,000,000 in damages. After a five-day trial, the jury returned a defense decision in two hours for Mr. Gittelman’s clients. Mr. Gittelman has also engaged in extensive law and motion practice over the course of his career and has won anti-SLAPP motions, motions to compel, motions in limine, and summary judgment motions. One such successful summary judgment motion involved a $25,000,000 coverage dispute, which was later upheld on appeal.
Mr. Gittelman obtained his J.D. from the University of San Diego School of Law. Before that, he attended New York University, where he obtained his B.A. in politics and journalism. While at NYU, Mr. Gittelman was a Trustee Scholar and earned the Chancellor’s Award for Volunteerism and Community Service. He currently volunteers with California Volunteers.
In his spare time, Mr. Gittelman enjoys cooking, as well as traveling and attending concerts with his wife. They both enjoy watching Yankees and Padres games with their dog, Jeter.
