California Annual Legal Update: NYC
On May 11, 2017, Tyson & Mendes hosted our spring California Annual Legal Update at the Ritz Carlton, Battery Park in New York City. Pat Mendes, Bob Tyson, Regina Silva, and Cayce Greiner led an engaging and interactive discussion centered around the most significant California insurance law updates, employment issues, and jury verdicts in 2016.
The session began with an overview of recent California case and statutory law relevant to claims professionals and their insureds led by Founder and Partner Pat Mendes. Pat also discussed developments that impact liability for businesses and exposure of insurance companies.
Partner Cayce Greiner then discussed case updates interpreting the landmark California Supreme Court case, Howell v. Hamilton Meats, on the “billed vs. paid” economic damages rule. In 2011, Howell drastically lowered the amount of medical damages awarded to a plaintiff at trial to what is actually paid by health insurance. Cayce discussed the methods plaintiffs’ attorneys commonly use to circumvent Howell and how to identify and defend against their methods in your case. Director of Employment Practices Regina Silva led a concurrent breakout session relevant to all California employers and EPL claims handlers. Regina discussed the latest trends impacting employers in California including wage and hour updates, new harassment/discrimination regulations, status of enforcement of arbitration agreements, and the latest EPL judicial decisions.
All attendees participated in an interactive discussion of recent California jury verdicts led by Founder and Managing Partner Bob Tyson and Cayce Greiner. Bob and Cayce drilled down three significant cases to expose why juries decide cases the way they do. Participants learned new techniques to assess claims and limit exposure in the most complex, high exposure cases.
The afternoon concluded with a lively networking reception complete with hors d’oeurves, drinks, and a beautiful sunset over the harbor.
