Margaret J. Phe is Senior Counsel in Tyson & Mendes’ Los Angeles office, where she is a member of the Complex Trial Team. Her practice focuses on general civil litigation defense. Ms. Phe possesses over 18 years of litigation experience before administrative, state, and federal courts throughout California. Prior to joining Tyson & Mendes, Ms. Phe worked for the California Department of Justice, Office of the Attorney General, where she prosecuted disciplinary actions against licensed health care professionals and defended State agencies, their employees, officials, and executives in civil due process, harassment, and discrimination lawsuits.
Ms. Phe is a seasoned litigator who practices with a no-nonsense style and believes transparency with clients is the best policy. Her strategy in working up cases and anticipating, “What would the judge do?” (WWJD) has led to efficient and successful resolutions of her cases during the pre-litigation stages, settlement hearings, and trial. Recently, she obtained summary judgment dismissal of a federal civil rights lawsuit filed against a State agency, its Board members, and its executive director after five years of litigation. During the pendency of the case, Ms. Phe successfully filed motions to dismiss and prevailed in several discovery hearings. In another federal civil rights due process lawsuit filed against a school district for failure to provide the minor student a free and appropriate education, Ms. Phe served as second-chair at trial and obtained a defense verdict. Ms. Phe has also briefed matters for the Ninth Circuit Court of Appeal, and prevailed in an action wherein the Ninth Circuit affirmed the district court’s denial of plaintiff’s request for preliminary injunctive relief. In addition, she has achieved positive results in state appellate courts in matters involving wrongful termination, retaliation, and assumption of the risk. She has extensive experience advising state agencies, its executive directors, and state boards in conflict resolution, and has also assisted with amendments of state statutes.
Ms. Phe obtained her B.A. from the University of Notre Dame. She earned her J.D. from Golden Gate University, where she obtained a specialization certificate in business law. Ms. Phe is admitted to all California Courts, the U.S. District Court for the Central and Southern Districts of California, and the U.S. Court of Appeals for the Ninth Circuit.
During her free time, Ms. Phe enjoys traveling with her husband and children. She is her kids’ number one fan at their sporting events. As a former fitness instructor, Ms. Phe maintains an active lifestyle as a snowboarder, kickboxer, runner, and coach to her kids.
